    BSKB Partners to Speak at 2014 PLI Patent Law Institute

    BSKB partners Gerald M. Murphy, Jr. and Leonard R. Svensson have been invited to speak at the Practising Law Institute (PLI)’s 8th annual Patent Law Institute. The 2014 Patent Law Institute will be held in New York, NY on February 3-4, 2014, and in San Francisco, CA on March 17-18, 2014. The seminar provides up to date information about U.S. patent law from seasoned practitioners, who lead breakout sessions that go into depth on such issues as prosecution and litigation.

    BSKB Co-Sponsors Howard University Law School’s 13th Annual IP Law Seminar – Gerald Murphy to Speak

    BSKB will co-sponsor the 13th Annual Intellectual Property Law Seminar hosted by Howard University’s Institute for Intellectual Property and Social Justice. The day-long seminar will be held at the Howard University School of Law on March 4, 2016, and will feature speakers from government entities, corporations and private practice covering a variety of intellectual property topics. Distinguished guests include Hon. Susan G. Braden of the U.S. Court of Federal Claims, Hon. Charles E. Bullock, Chief Judge of the U.S. International Trade Commission, Lucinda Longcroft, Head of the WIPO New York Office and Hon. Sharon Prost of the U.S. Court of Appeals for the Federal Circuit.     BSKB partner Gerald Murphy, Jr. and associate Lynde Herzbach will speak at an upcoming webinar entitled “Cuozzo Challenges Inter Partes Review: So What?” The webinar will be hosted by IP Watchdog’s Gene Quinn as part of Patent Masterminds: An Innography Series. The webinar will discuss Inter Partes Review (IPR) post grant proceedings in light of the Cuozzo Speed Technologies v. Lee case at the Supreme Court and what this means for future IPR proceedings.

    Law360 Quotes Partner Charles Gorenstein on Recent Patent Agent Privilege Decision

    BSKB partner Charles Gorenstein was quoted in a March 9, 2016 Law360 article discussing the recent Federal Circuit decision regarding patent agent privilege. The decision recognizes a privilege that applies to communication between patent applicants and patent agents, but extends only to communications necessary to prosecute patents and to engage in other activities for which agents are authorized. Prior to this decision, some district courts recognized patent agent privilege, while others did not. Mr. Gorenstein states, “The biggest effect here is the certainty. The court has taken an issue that has been bouncing around the district courts for a time and let everyone know where the line is. We know where there is privilege and where there is not privilege, and certainty is good.”

    James Slattery and Binli Guan to Speak at China Trademark Annual Meeting

    James Slattery, partner at BSKB, and Binli Guan, IP Advisor at BSKB, have been invited to speak at the 2012 China Trademark Annual Meeting in Kunming. The meeting, sponsored by the Chinese Trademark Association, will be held September 3 to 5, 2012. Mr. Slattery and Ms. Guan will lecture in conjunction with the World Intellectual Property Organization (WIPO), addressing particular problems relating to prosecuting trademark applications in the USPTO based on the Madrid Protocol.

    Law360 Quotes Partner Charles Gorenstein on Potential Impact of Federal Hiring Freeze on USPTO

    BSKB partner Charles Gorenstein was quoted in a January 24, 2017 Law360 article entitled “Federal Hiring Freeze Could Hurt Patent Quality,” where he discussed the potential impact of the recently instituted federal hiring freeze on processes at the U.S. Patent and Trademark Office (USPTO). Potential impact of the freeze at the USPTO includes possible delays in the patent process, from application intake to examination, as well as the potential for a decrease in quality, as attempts are made to stay on deadline with increased workloads. Mr. Gorenstein notes that the patent office might be particularly susceptible to the effects of this freeze because there has historically been a relatively high turnover rate in the examining corps. He also states “If they continue to lose examiners at really any rate — a normal rate or a higher-than-normal rate — and if they can’t replace them, then inevitably we’ll see a slowdown of output and the backlog will increase. Obviously, that’s going to happen if there are fewer people to do the work.”

    BSKB partner Greg Hsu and BSKB IP Advisor Binli Guan will present lectures regarding recent changes in U.S. IP law at a one-day seminar in Taipei on March 20, 2013. Mr. Hsu will present a lecture entitled “The Coming of a New Era – Detailed Analysis of the Final Rules and Examination Guidelines of the First Inventor to File System.” Ms. Guan will discuss recent changes in U.S. trademark practice, including the introduction of new gTLD registers and internet use and trademark monitoring.     BSKB Partners to Speak on U.S. Patent Law Changes to INFOPAT Group in Japan

    BSKB partners Marc S. Weiner and Eugene T. Perez have been invited to speak in Tokyo, Japan to members of the Association for the Study of International & Foreign Patent Trademark Laws & Practice (INFOPAT) on May 10, 2012. Their lecture, entitled “First Inventor to File, Prior Art and Priority under the Leahy-Smith America Invents Act: Transitioning to the New U.S. Patent Law,” will cover the changes to 35 U.S.C. §§ 102 (anticipation) and 103 (obviousness/inventive step) due to the 2011 America Invents Act (AIA). This lecture will also cover §§ 102/103 before and after the effective law date of March 16, 2013, as well as specific topics such as the 1-year grace period, when U.S. patents and patent application publications are available as prior art, and filing by an assignee.

    Andrew Meikle to Speak at FICPI’s 16th Open Forum in St. Petersburg

    BSKB partner Andrew D. Meikle will speak at the Fédération Internationale des Conseils en Propriété Industrielle (FICPI) 16th Open Forum, held October 5-8, 2016, in St. Petersburg, Russia. Mr. Meikle, who is President of the U.S. section of FICPI, will be speaking on a panel addressing how companies can better protect their inventions and improve internal processes, such as communication with inventors. The FICPI Open Forum offers attendees from around the world a chance to come together to discuss the changing landscape of IP, with specialized sessions for patent attorneys and trademark attorneys, as well as sessions on business practice issues.

    BSKB partners Gerald M. Murphy, Jr. and Craig A. McRobbie will present lectures on chemical, pharmaceutical and biotech patent prosecution and post grant practice at the Practising Law Institute (PLI)’s 11th Annual Patent Law Institute in April 2017. The annual Patent Law Institute is directed towards patent prosecutors, patent litigators and strategic/transactional lawyers, and features plenary sessions as well as separate breakout sessions for each subgroup of practitioners. Other featured speakers include federal judges, government officials, academics and in-house counsel, and the sessions will cover updates to laws affecting patent practice as well as practical suggestions for practitioners. The 2017 Patent Law Institute will be held in New York, NY on April 6-7, 2017 and in San Francisco, CA and via webcast on April 27-28, 2017. Mr. Murphy and Mr. McRobbie have been speakers at the Patent Law Institute since 2009 and 2016, respectively.

    CAFC Reverses USPTO Ruling on Leo Pharma Patent

    The Federal Circuit reversed a USPTO decision of obviousness and claim construction on Leo Pharmaceutical Products Ltd.’s psoriasis drug patent on Monday, August 12, 2013. The Federal Circuit’s decision to reverse the USPTO’s conclusion (Director Rea) that the patent was unpatentable was made after finding that Leo Pharmaceutical’s invention solved the long-felt but unmet need of storage stability of the drug, which the prior art did not address. The Federal Circuit also found that the USPTO erred in its claim construction of “storage stable” in the reexamined patent claims. BSKB’s Andrew Meikle, Leonard Svensson, and Eugene Perez are among the representatives of Leo Pharmaceuticals Products Ltd. The inter partes reexamination control number is 95/000153 and was originally filed in 2006.
