It is well established that the International Trade Commission (“ITC”) has the authority to bar the importation of “articles” that infringe a U.S. patent, subject to the “Tariff Act of 1930” (19 U.S.C. § 1337). This case focuses on whether the term “articles” used in the Tariff Act covers digital data files, and thus whether the ITC has the authority to bar the importation of digital data files by ClearCorrect that infringe on numerous patents owned by Align Technology, Inc
