Key Topics in IP for 2023

2022 has come and gone, and now it’s time to look forward to IP in 2023. Eugene Perez was recently quoted in IPWatchdog discussing the key topics to look forward to in the coming year. While discussing rigid rules imposed by the Federal Circuit, especially with regard to antibody therapeutics, he states “complex technology can lead to court decisions that can significantly impact patent prosecution and litigation… I hope that the Supreme Court will simply reverse the “full scope” requirement, not just to keep it simple and to save the antibody industry, but to avoid creating an enablement standard that will complicate patent prosecution and increase litigation for years to come.”
