Who Owns ‘Skin’? Kardashian’s ‘SKKN’ Facing Trademark Ambiguity

BSKB Partner Michael T. Smith was quoted recently in an article regarding Kim Kardashian's new skin care line, "SKKN by Kim". 

This article discusses how, despite the uncertainty surrounding the trademark and the "accusations that the Kardashian family steals IP from women of color," the line planned to launch as scheduled. There are other brands that also claim the trademarked brand name and sell similar products, which brings into question who has the right to this trademark.

Michael T. Smith was quoted saying the following:

“In this case, I think the marks are very similar. The goods seem to be the same or closely related. When those two factors weigh in favor of infringement, then typically you have a pretty good case.”
