Partner Robert J. Kenney Quoted in Managing Trade Marks Article on Louis Vuitton v. Warner Bros Case
BSKB partner Robert J. Kenney was quoted in a June 22, 2012 Managing Trade Marks article about Louis Vuitton’s trademark infringement suit against Warner Brothers, which was dismissed by the Southern District of New York. The case involved likelihood of confusion in the use of a knockoff Louis Vuitton bag in the movie “The Hangover Part II.” Highlighting alternatives to filing a law suit in cases such as this one, Robert Kenney stated that “…the better course would have been for Louis Vuitton to write a letter and say we prefer you not to use these counterfeit goods in any works in the future. It’s always a question of how far do you want to go. Not every situation you perceive is misuse of a mark requires a lawsuit.”
