Below you will find downloadable copies of our Declaration, Power of Attorney and Assignment forms for your use.

The forms are posted in either Microsoft Word® or Adobe® Portable Document Format (PDF). In order to view and print the PDF versions of the forms, you will need a copy of Adobe Acrobat Reader® software. Under the America Invents Act (AIA) rules, the United States Patent and Trademark Office (USPTO) still requires that where an application is assigned, a Declaration and Assignment must be executed by the inventors.

However, the AIA expands who may be an Applicant. Inventors are no longer the only possible Applicants. Applicants may also be the Party to whom the Invention has been assigned, the Party to whom the inventor is under obligation to assign or the Party who otherwise shows proprietary interest in the matter.

The USPTO requires that the “Applicant” sign the Power of Attorney. When the Assignee is the Applicant, a Power of Attorney (PTO/AIA/82B) is to be signed by a representative of the Assignee. Where the Applicant wants to prepare a case specific Power of Attorney form PTO/AIA/82A is also required.

When the Assignee is not the Applicant, a Power of Attorney (PTO/AIA/80), is to be signed by a representative of the Assignee. Where the Assignee wants to prepare a case specific Power of Attorney a Statement under 37 C.F.R. 3.73(c) is also required.
