USPTO Fee Increases Now Law

New Patent Fees In Effect 8 December 2004

The omnibus funding bill (H.R. 4818, The Consolidated Appropriations Act, 2005) which includes revisions to the USPTO fees was enacted into law today, 8 December 2004, upon the President's signature. The new patent fees are now in effect. The adjustments to the trademark fees will come into force at a date yet to be determined by the USPTO.

For more details on the new fee structures, please see our BSKB IP Updates article from last week, now posted to our website, and the USPTO's announcement. The current USPTO fees may be viewed at the USPTO website.

As of last check, the CREATE Act, also mentioned in the latest BSKB IP Updates, has not yet been signed into law.

Electronic Version Requested

This is a reminder that in view of requirements set by the USPTO, we request that you forward an electronic version of all new applications (specification, claims and abstract) at your earliest convenience, preferably together with your new application order letter. This can be done by either secure e-mail or diskette in Microsoft Word®-compatible format. Since it is necessary to provide substitute paragraphs when making amendments to both the specification and claims, it is of great assistance to us to have an electronic version available. The availability of an electronic version not only assists in accuracy, but also reduces the attorney time/cost involved in reviewing the amendments. We appreciate your cooperation in this regard.

Current versions of these forms are available on our web page in both "fillable" and "downloadable" format. Word processing versions are also available upon request.
