Experience:

  • Mr. Botts has practiced in the intellectual property field since 1986.  Since 2002, he has emphasized electronics and computer design and software technologies in his practice.

  • Mr. Botts has extensive litigation experience with nearly 40 first chair trials in state and federal courts across the country.  Mike has represented individuals and corporations in industries involving electronics and computers, medical research, publishing, and consumer products.  He has served as lead trial counsel in cases involving all areas of intellectual property rights, including patent infringement, trademarks,  trade secrets, and copyrights. 

  • Mr. Botts has also taken the lead in litigations and trials involving defamation and publication issues (business and personal libel, slander, privacy, and First Amendment), medical actions (medical research, medical malpractice, consumer protection, Federal Employers Liability Act (FELA)), contracts (IP licensing, insurance law, breach of contract, consumer and business fraud, RICO, Federal Tort Claims Act (Qui Tam), and construction litigation), and tort law.

  • Mr. Botts is skilled in writing validity opinions as well as in counseling, licensing, and dispute resolution involving intellectual property and related business matters. 

  • Mr. Botts drafts and prosecutes patent applications involving electrical and computer technologies.

  • Former Patent Examiner, U.S. Patent and Trademark Office, also qualified as an International Search Examiner for the Patent Cooperation Treaty (PCT), 2005-2007.

  • Former Assistant Attorney General in Iowa, fraud litigation attorney and counsel to administrative agencies, 1985-1987. 

  • Former Judicial Clerk, Iowa’s Second Judicial District, 1983-1984.
