Experience:
Mr. Birch has practiced in the intellectual property field since 1965,
specializing in mechanical and design patents and patent interferences.
While in the Patent Office, Mr. Birchs experience included examination of patent
applications in Class 250, Radiant Energy, with particular emphasis in the
areas of qualitative and quantitative chemical analysis by the use of mass spectrometers,
spectrophotometers, X-ray diffraction analyzers and electron beam technology. He examined
patent applications on ultra-violet water purification devices, X-ray photography, corona
discharge generators, photocell control systems, and nondestructive testing of materials
by the use of radiant energy and associated optics. Mr. Birchs experience with the
firm of Birch, Stewart, Kolasch & Birch, LLP includes all facets of prosecution of
patent, trademark and copyright applications, particularly electrical and mechanical
prosecution. He has particular expertise in arts involving optics, mass spectrometers,
X-rays, electron microscopy and computer related technologies. Mr. Birchs activities
include the managing and prosecution of large international patent portfolios for major
clients, requiring frequent communications with inventors to ensure the preparation of
applications to support broad patent protection. He manages and prosecutes applications
before the U.S. Patent and Trademark Office and various foreign patent offices. His patent
experience also includes licensing, litigation, arbitration of licensing disputes,
interference practice and oral arguments before the Court of Appeals for the Federal
Circuit.
